TERMS OF SERVICE

These Terms of Service govern your access to and use of https://northernhour.com/ and purchases from NorthernHour.

By using the website or placing an order, you agree to these Terms, together with our Return and Refund Policy, Shipping Policy, Warranty Policy and Privacy Policy.

Nothing in these Terms excludes consumer rights that cannot legally be excluded.

1. Eligibility

You must be legally capable of entering into a binding agreement in your jurisdiction or have permission from a parent or legal guardian.

You may not use the website for an unlawful, fraudulent or unauthorized purpose.

2. Store Platform

Our store is hosted by Shopify, which provides the e-commerce platform that allows us to display and sell products.

Your use of payment, accelerated checkout or other third-party services may also be subject to the provider’s terms and privacy policy.

3. Product Information

NorthernHour attempts to present product descriptions, specifications, photographs, renders, dimensions, colours and prices accurately.

However:

  • Screens may display colours differently;

  • Handmade or assembled products may have minor variations;

  • Brushing, polishing, alignment and finishing may vary slightly;

  • Product images may include digital renders or representative photographs;

  • Component designs may be updated where equivalent parts are required; and

  • Mechanical watches may experience ordinary variation in timekeeping.

Minor variations that do not materially change the product’s identity, function or confirmed configuration are not necessarily defects.

NorthernHour will not make a material substitution to a custom order without communicating with the customer.

4. Custom Configurator

Customers are responsible for reviewing all configuration selections before placing an order.

The order confirmation forms the primary record of the requested configuration. Contact NorthernHour immediately if the confirmation does not match the intended selections.

Some component combinations may be technically incompatible. If this occurs, NorthernHour may contact the customer to approve an alternative, provide a refund for the affected option or cancel and refund the order.

Custom-configured products are subject to the Custom Order provisions in our Return and Refund Policy.

5. Independent Brand and Affiliation Notice

NorthernHour is an independent custom-watch business.

Unless expressly stated, NorthernHour is not affiliated with, authorized by, endorsed by or sponsored by Seiko, Rolex, Audemars Piguet, Patek Philippe, Cartier or any other third-party watch company.

Third-party trademarks, model references and brand names belong to their respective owners. Any permitted references are used only to identify component compatibility, movement type or general design inspiration and do not imply affiliation.

A component will be described as genuine or authentic only where NorthernHour has a reasonable basis for that description.

6. Orders and Acceptance

Submitting an order is an offer to purchase.

NorthernHour may accept, reject, place on hold or cancel an order for reasons including:

  • Product or component unavailability;

  • Pricing or description errors;

  • Suspected fraud;

  • Payment failure;

  • Shipping restrictions;

  • Technical incompatibility;

  • Legal or regulatory restrictions; or

  • An inability to complete the selected configuration.

If NorthernHour cancels a paid order, the applicable amount will be refunded to the original payment method.

7. Prices, Currency and Taxes

Prices may be displayed in different currencies based on location or market settings.

The final price, currency, shipping charge and applicable taxes will be shown at checkout. Your payment provider may apply currency-conversion or international transaction fees.

Prices and promotions may change without notice, but changes will not ordinarily affect an accepted order unless correction of an obvious error is legally permitted.

Import duties, taxes and brokerage charges are governed by the Shipping Policy.

8. Payments

You agree to provide current, complete and accurate billing and payment information.

By submitting payment details, you represent that you are authorized to use the selected payment method.

NorthernHour may use payment and fraud-prevention providers to verify transactions and may request additional information before accepting or shipping an order.

9. Promotions and Discount Codes

Promotions and discount codes:

  • Must be used before expiry;

  • Cannot be combined unless expressly stated;

  • Have no cash value;

  • Cannot ordinarily be applied retroactively;

  • May be limited by product, location or customer; and

  • May be cancelled where obtained or used fraudulently.

If a refund is issued for a discounted order, the refund will not exceed the amount actually paid for the returned product.

10. Shipping, Returns and Warranty

Shipping, delivery, cancellations, returns, refunds and warranty services are governed by the corresponding NorthernHour policies published on the website.

Those policies form part of these Terms.

11. Acceptable Use

You may not:

  • Use the website for unlawful activity;

  • Attempt to gain unauthorized access;

  • Introduce malware or harmful code;

  • Scrape, copy or extract website content through unauthorized automated methods;

  • Interfere with website security or operation;

  • Impersonate another person;

  • Submit false reviews or fraudulent claims;

  • Use another person’s payment information without permission; or

  • Infringe intellectual-property or privacy rights.

NorthernHour may restrict access or cancel affected orders where misuse is reasonably suspected.

12. Intellectual Property

Website content, including NorthernHour branding, original product photography, text, graphics, configurator materials, layouts and designs, is owned by or licensed to NorthernHour and is protected by applicable intellectual-property laws.

You may use the website for personal, non-commercial shopping purposes. No content may be copied, reproduced, republished, sold or commercially exploited without written permission.

Third-party trademarks remain the property of their respective owners.

13. Reviews and Customer Content

If you submit a review, photograph, video or other content, you represent that:

  • You created it or have permission to submit it;

  • It is accurate to the best of your knowledge;

  • It does not violate another person’s rights; and

  • It is not unlawful, threatening, defamatory, deceptive or malicious.

You grant NorthernHour a non-exclusive, worldwide, royalty-free licence to use, reproduce and display submitted content for business and promotional purposes, subject to applicable privacy law and any express agreement made with you.

NorthernHour may remove content that violates these Terms.

14. Third-Party Services and Links

NorthernHour may provide access to third-party services, payment methods, social-media platforms or links.

Third-party services are governed by their own terms. NorthernHour is not responsible for third-party content, availability or conduct except where liability cannot legally be excluded.

15. Disclaimer

To the maximum extent permitted by law, the website is provided on an “as available” basis.

NorthernHour does not guarantee uninterrupted website access or that all errors will be corrected immediately.

Product warranties are limited to those expressly provided in the One-Year Limited Warranty Policy and any warranties that cannot legally be excluded.

16. Limitation of Liability

To the maximum extent permitted by law, NorthernHour will not be liable for indirect, incidental, special or consequential losses arising from use of the website or products where such losses were not reasonably foreseeable.

Where liability may legally be limited, NorthernHour’s aggregate liability relating to a product will not exceed the amount paid for the product giving rise to the claim.

Nothing in these Terms limits liability for:

  • Fraud or fraudulent misrepresentation;

  • Gross negligence or wilful misconduct;

  • Death or personal injury where liability cannot be excluded;

  • Breach of mandatory consumer rights; or

  • Any other liability that cannot legally be limited.

17. Indemnification

To the extent permitted by law, you agree to compensate NorthernHour for reasonable losses arising directly from your unlawful use of the website, fraud, infringement of third-party rights or material violation of these Terms.

This section does not apply to ordinary consumer complaints or the exercise of lawful consumer rights.

18. Governing Law

These Terms are governed by the laws of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles.

The courts located in Ontario will have jurisdiction where legally permitted.

Customers may also benefit from mandatory consumer protections and legal forums available in their home jurisdiction. This governing-law section does not remove those mandatory rights.

19. Severability

If any provision is found invalid or unenforceable, that provision will be limited or removed only to the extent necessary. The remaining provisions will continue in effect.

20. No Waiver

A delay or failure by NorthernHour to enforce a provision does not waive the right to enforce it later.

21. Changes to These Terms

NorthernHour may update these Terms from time to time.

The updated version will be posted with a new “Last updated” date. Changes will apply prospectively unless applicable law permits otherwise.

22. Entire Agreement

These Terms and the policies incorporated into them constitute the agreement between you and NorthernHour concerning website use and purchases, subject to any additional written agreement expressly accepted by NorthernHour.
